Alveus XR Models License

This is the legal text of the Alveus XR Models License. Please read the following carefully.

Alveus XR allows the acquisition of its 3D models through two different licenses:

  1. Personal License
  2. Professional License

1. Personal License

This type of license is intended for the use of models by individuals, freelancers or small and medium enterprises (up to a maximum annual turnover of 100,000 €). This type of license supports commercial uses of any kind, as long as the intellectual property of the models acquired from Alveus XR and the artists authors of the models is recognized, which will be in any case non-transferable. Only in the case of a company, it is allowed to share the model among the working members of the same company, but in no case to share it with any other person or company, neither for free nor through a sale process.

2. Professional License

This type of license is designed for the use of models by large companies (those that exceed the barrier of 100,000 € annual turnover). This type of license supports commercial uses of any kind, as long as the intellectual property of the models acquired from Alveus XR and the artists authors of the models is recognized, which will be in any case non-transferable. It is allowed to share the model among the members of the same for the internal work of the company, but in no case to share it with any other person or company, neither for free nor through a sale process.

In addition to their specific conditions, the following general conditions apply to all three types of licenses:

Intellectual Property of Alveus XR Models: The models in this repository are the intellectual property of the Alveus XR project and their authors, whose names can be found on the web page of each asset as well as in the historical-archaeological file of each asset. The intellectual property of the models acquired from Alveus XR and the artists authors of the models must be acknowledged and credited and is not undermined by the modification of the models.

Modifications of 3D Models: Modifying the 3D models acquired from Alveus XR is allowed. However, it should be noted that regardless of how much a 3D model is modified, it remains subject to the rules set forth in this license and cannot be distributed in any form, whether for free or through a sales process.

Sale of 3D Models to Third Parties: The sale of Alveus XR 3D models to third parties is strictly prohibited. 3D models that were previously available in the Alveus XR store can only be sold on that platform, and their sale or free distribution externally is not permitted. It is also not allowed to sell any modified Alveus XR 3D models.

Use in Video Games and Software: This use is permitted (for example, integrating 3D models into Unity or Unreal), as long as the 3D files are part of a larger creation and are not in an open format that allows others to access the underlying data of the 3D model. Under no circumstances is it allowed to give away the 3D model file itself.

License Expiration: Alveus XR licenses are perpetual and do not expire. The acquired 3D models can be used indefinitely. Only in the event that the platform no longer has support and the website needs to be closed, it will no longer be possible to download the models. In such a case, all customers will be notified with sufficient time to download the 3D models.

Refunds: No refunds are allowed for the acquired 3D models.

Guarantees

The client commits, declares, and guarantees to Alveus XR that:

  • They have full right, power, legal capacity, and authority to enter into and fulfill this agreement, have obtained any necessary consent from Alveus XR to do so, and, prior to any purchase, have had the opportunity to seek independent legal advice.
  • They will not use the 3D models except in accordance with the terms of this agreement. In the event of unauthorized use of the 3D models, they accept any reasonable fees or penalties applied by Alveus XR under this agreement or applicable law.
  • Prior to the purchase, they will accept the present license document that allows the use of the Intellectual Property and will not use the 3D models to infringe upon the intellectual property rights of Alveus XR or the authors of the models.
  • They will immediately notify Alveus XR of any legal claim or challenge against their use of the 3D models or any other rights-related issue before disclosing such issue to any third party.

This 3D model license is valid for the purchase and use of assets from Alveus XR starting from June 1, 2023.
